This Model Release Form relates to the use of personal media and images utilized for an artistic, promotional or commercial endeavor by and between the following parties:

 

Miguel Angel Lobo, a photographer and videographer, working with LOBO MEDIA STUDIO, with an address at the following:

 

3085 Beyer blvd Ste A-103, San Diego, CA. 92154

 

and Everyone person or company (hereinafter called "Model") that has filling and sent the I.C.form and having marked the box where you accept the conditions of the same to request the status of Independent Collaborator (hereinafter called "I.C."), with an address located in any part of the world, but, detailed and provided in the I.C.form.

 

 

I, the "Model", for good and valuable consideration, the receipt of which is hereby acknowledged, hereby absolutely and irrevocably authorize Miguel Angel Lobo and LOBO MEDIA STUDIO as well as their legal representatives, assignees, and transferees to use, publish, reuse, republish, distribute, disseminate or otherwise make publicly available for any artistic, promotional or commercial use, including advertising, publication, or illustration images of me and/or my property, of the following description:

 

Images, Illustrations, Drawings, Photos, Portraits, or anyone image where I appear, taken by Miguel Angel Lobo or any representative from the LOBO MEDIA STUDIO, including all files sending by me through this web site, where my person appear in whole or in part, whether individually or collectively with any other material, in any and all forms of media now or hereinafter known and/or developed, including, but not limited to, in print media, in digital media, on the Internet, in composite images, or distorted images or for any other lawful use as may be determined by Miguel Angel Lobo and LOBO MEDIA STUDIO in their sole and exclusive discretion, including the use of my name without restriction. 

 

The artist and studio shall specifically be permitted to use fictitious names in conjunction with the images.

 

I further completely release and discharge Miguel Angel Lobo and LOBO MEDIA STUDIO from any and all demands or claims that may arise out of or otherwise be connected with the use of the photographs and video featuring me, my image or my property, including, without limitation, and any all claims for the violation of a right of publicity, a right of privacy, or libel. I also waive any and all rights to approve or otherwise review any uses of the photographs and video featuring me, my image or my property.

 

This authorization and release shall inure to the benefit of the legal representatives, licensees, heirs and assignees of Miguel Angel Lobo and LOBO MEDIA STUDIO and shall also be binding upon me, my heirs, assignees, and legal representatives.

Notwithstanding the above, the following uses are specifically excluded:

 

Is not authorized to use in cigarettes, alcohol or drug sales, pornography, memes, or any use that cause  damage to my image, honorability and reputation.

 

RECITALS:

 

WHEREAS, Model is willing to release rights, in the use of personal media and images to Miguel Angel Lobo and LOBO MEDIA STUDIO.

 

NOW, therefore, in consideration of the promises and covenants contained herein, as well as other good and valuable consideration (the receipt and sufficiency of which is hereby acknowledged), the Parties do hereby agree as follows:

 

 

Article 1 - RELEASE:

 

Model hereby releases, and Miguel Angel Lobo and LOBO MEDIA STUDIO does accept, the absolute and unconditional right to sell, reproduce, publish, prepare derivate works, distribute, perform, and/or display the personal media and images, as applicable.  

 

 

Article 2 - REPRESENTATIONS:

 

Model hereby represents and warrants that Model is the exclusive holder of any all rights in and to their personal media and images, and that no other individual or entity may claim any rights, title and/or interest in and to said Works.  Model additionally warrants that Model has all necessary rights required to grant this release.

 

Article 3 - AGE OF CONSENT

 

Model hereby warrants that Model is of full legal age and has the right to contract in the state of California and the United States of America.

or I am the parent or guardian of the Model and am a legally competent adult of full legal age. 

I have read this document thoroughly and understand the entirety of its contents in full.

 

Article 4 - ASSIGNMENT:

 

The rights and obligations under this agreement will inure to the benefit and be binding upon any of Model's successors and assignees, as well as any of Miguel Angel Lobo and LOBO MEDIA's successors and assignees.

 

 

Article 5 - JURISDICTION & GOVERNING LAW

 

Model specifically agrees that this Model Release shall be governed and interpreted in accordance with the laws of the state of California and should any provision of this Model Release be judged by an appropriate court of competent jurisdiction as invalid, it shall not affect any of the remaining provisions in any way, to the extent possible.

 

 

Article 6 - ADVICE OF COUNSEL

 

Model acknowledges that Model had reasonable and sufficient opportunity to obtain independent legal advice regarding this Release. Model covenants that Model has either received such independent legal advice prior to executing this Agreement or that Model has independently and willingly chosen not to obtain legal advice and is executing this Release without doing so.

 

 

Article 7 - ENTIRE AGREEMENT

 

This Release constitutes the entire agreement between the parties and supersedes any prior or

contemporaneous understandings, whether written or oral.

IN WITNESS WHEREOF, the Parties execute the Agreement as follows:

 

1.- Model accept this Release, at moment that the check box on the I.C.Form has been      checked.

 

2.- Model declare that all information submitted into the I.C.Form is complete and truth.

 

3.- Model read and understood the conditions before accepting this Release.

 

4.- Model accept the I.C.Form submitted as an acceptable way to execute this release agreement.

 

 

 

This "Release", is effective immediately as of the date that the roll of “I.C.” is assumed by "creator" throught the LOBO MEDIA STUDIO web site.
